Potential personal injury Claims related to the iPhone 4?

A Sacramento Calif-based personal injury law firm has launched an investigation into “potential problems” with the newly released iPhone 4.

Personal Injury Attorneys Kershaw, Cutter & Ratinoff LLP have posted the following on their website,“If you recently purchased the new iPhone and have experienced poor reception quality, dropped calls and weak signals, we would like to hear from you."

The iPhone 4 has come under criticism for its design, specifically the positioning of the antenna. It is claimed that if the iPhone is held in a certain way, the electrical conductivity of the phone user's skin will negatively affect the phone's reception, leading to dropped calls and poor reception.

It is unclear yet if legal action/ personal injury action will be able to be taken against apple based on this apparent design defect. the issue depends on whether Apple were aware of the defect and made it that way intentionally so that iPhone users would have to buy an accessory to fix it. A similar law has been used to investigate MySpace and Facebook in the past (November 2009).
