Negligence In Personal Injury Cases
Negligence comes in two different forms: an action or an in-action. An action is when someone physically does something that causes injury to another. For example, if a construction worker throws a brick off a building and it hits someone below, this is a negligent action.
Joint Liability
One of the key elements in any civil case is determining who is liable and to what degree they are responsible for the plaintiff's injuries. Most of the time it is easy to arbitrate who is liable as, more often than not, only a single person or entity is responsible for the harm caused.
However, there are times when more than one individual or institution is shown to be liable and this is where joint liability comes in. In essence, joint liability is when two or more individuals or institutions are considered to be responsible for any injury caused to the plaintiff.
Toxic and Chemical Exposure
It is quite hard to figure out whether an injury/sickness suffered is related to exposure to toxic substances or chemical exposure.
In the United States, the term “toxic tort” is used to depict an increasing area of the law that covers issues as diverse as lead poisoning, tobacco, asbestos, contaminated groundwater exposure, toxic mold, medical devices and prescription medication. While federal and state governments move forward for tort reform to limit toxic tort litigations from flaring up in the court systems, toxic tort cases keep on expanding into new areas.
Traumatic Brain Injury: Filing A Personal injury Claim For Traumatic Brain Injuries
A traumatic brain injury or "acquired brain injury" or "head injury" happens when sudden trauma causes damage to the brain. Symptoms of a mild traumatic brain injury can include headaches, dizziness, lightheadedness, confusion, tired eyes or blurred vision, fatigue, and ringing in the ears. Sometimes victims also experience a change in sleep patterns and their moods. They also have trouble with memory, attention, concentration, or thinking.
